Luminus

Plagiarism: myOtaku.com members may not submit any content that they themselves did not author, draw, or otherwise create. For artwork, myOtaku members may not trace or submit another person's artwork, even with that person's permission. When creating a wallpaper or collage, members may use someone else's artwork if they get that person's permission.
I'm new here and I'm curious about this. There are many instances on this site where artwork is clearly being taken from previously created artwork. In some cases, it may be just my suspicion, but I have visited MANY sites and there are very familiar, if not exact, pictures displayed here.) Examples:

http://fanart.theotaku.com/view.php?action=retrieve&id=64723 Found here: http://templeotrunks.com/images/fan_art/3SAYINS.jpg And here: http://templeotrunks.com/images/fan_art/trunkscgmc.jpg It looks like it was originally a television screen cap.
http://fanart.theotaku.com/view.php?action=retrieve&id=64009
http://fanart.theotaku.com/view.php?action=retrieve&id=62637
http://fanart.theotaku.com/view.php?action=retrieve&id=61658
And many more. I don't have time to find the originals, but a quick google of those images will net you some "incriminating" results. So, with that in mind, I was wondering how the rules worked in recreated work using Illustrator or Photoshop. I have some drawings that I did in Illustrator, based on official pictures for the Dragonball franchise. I registered because I wanted to post them, but if I can't, I have no need to be registered. Semjaza
I know there's examples of some direct rips on the site, but they're mostly taken care of as soon as possible. It's hard to keep all of that in line. What you're showing here kind of confuses me, however. A lot of the work on the site is obviously based off of official drawings (which I have a bit of a problem with in the first place personally). Who is to say that all three of these drawings weren't originally based off of something Toriyama (or some animator for the shows) originally did and then they drew it themselves? There's a very large possibility that none of these people have even seen eachother's drawings in that case.... somewhat like your idea of basing your own work off of official images. I think theOtaku's rules more or less include something like someone taking an image from another person's site that's exactly the same and deleting their copyright information off of it. Not people all doing their art based off a similar official picture. Plus it's possible that some of these are by the same person, regardless of being on different sites. Of course, that would take some research and contacting the people on the other sites. So I don't know. I'd not worry about putting something up based off of official art. I could be reading this all wrong and not getting your point, though.
Japan
Fanart is just a fan's drawing of an official image or copyrighted thing. They may be good at copying what they see. By that I don't mean tracing. They may be good at looking at a picture and drawing the same exact thing on another piece of paper. I do that all the time, and I know others who are very good at that. Also, they may of seen some various fanart that they really like, so they draw that fanart in the way mentioned above. I like to do that also. It helps me to become a little better at drawing the specific character. Or, just like Tony said, it'd could be the same artist, but on different sites. I do that also. I have some of the same drawings here and also on deviantart.
James
Tony had it right. If we stopped people from drawing or recreating something official, we'd have no art site. It's called "fan art" because it's fan-produced art, which is based on various official works. If someone directly rips an entire graphic from somewhere else and writes their own name on it, then yes, we'll take action against that. But if someone re-draws an official image or they create their own composition or whatever, that's fine. I think we tend to find a balance between the two.
